Terms of Service

These Terms of Service govern access to and use of the Orca website, account system, Community, beta features, model packages, and related services operated by Curvature Flow (Shenzhen) Technology Co., Ltd. These terms should be read together with the User Manual, Privacy Policy, and AI-Generated Design Notice.

Acceptance of terms

By creating an account, logging in, submitting a form, browsing Community, ordering a model package, or using Orca, the user agrees to these Terms of Service. If a user does not agree, the user should not use Orca.

Accounts and security

Users are responsible for providing accurate account information, maintaining credential security, and all activity under their accounts. Orca may suspend or restrict accounts that appear inaccurate, compromised, abusive, unlawful, or harmful to the platform.

Beta and early-access status

Orca features may be experimental, incomplete, limited, unavailable, or changed without notice during beta. Orca may approve, reject, pause, or revoke beta access at its discretion to protect product quality, safety, legal compliance, and platform security.

Community and model packages

Community access, model preview, parameter adjustment, model ordering, and DIY package download are provided for approved users under the current beta rules. Each user may be limited to one free model claim during beta. Orca may change limits, pricing, availability, model metadata, licenses, and download rules as the product evolves.

AI-generated design risk

Models and packages may be generated or modified with AI. Users must read and accept the AI-Generated Design Notice before downloading model packages. Orca does not guarantee that any design is safe, manufacturable, legally compliant, fit for a particular purpose, or free from defects.

Local compliance

Users are responsible for complying with all applicable laws, regulations, standards, certifications, import and export controls, consumer protection rules, product safety rules, workplace safety rules, and intellectual property laws in the user's country or region, the manufacturing location, the shipping destination, and any other applicable jurisdiction. Orca does not provide legal, engineering, manufacturing, compliance, or certification advice, and users must independently confirm whether a design, download, fabrication, distribution, sale, import, export, or use is lawful before proceeding.

Prohibited use

Users must not use Orca for unlawful, harmful, deceptive, infringing, unsafe, abusive, privacy-violating, export-control-violating, or security-violating activity. Orca must not be used to create, request, modify, download, manufacture, sell, share, import, export, or distribute illegal designs, dangerous-goods designs, weapons, weapon parts, explosive devices, hazardous chemicals, unsafe pressure vessels, harmful tools, or designs intended to injure people, bypass safety controls, evade certification, or evade legal regulation.

User content and licenses

Users retain ownership of content they submit, unless otherwise agreed. By submitting, uploading, commenting, or publishing content on Orca, users confirm they have the necessary rights and grant Orca a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, process, adapt for technical compatibility, translate, distribute through the platform, moderate, and use the content to operate, secure, support, and improve Orca.

Orca Official content

Designs, datasets, model files, drawings, renderings, metadata, documentation, software, interface elements, trademarks, and related content published by Orca Official are owned by Orca or Curvature Flow (Shenzhen) Technology Co., Ltd. unless otherwise stated. Users may only use such content under the license or permission displayed for the specific item.

Open-source and content licenses

Each dataset, model, drawing, rendering, or package may be subject to its own license, such as CC BY-NC or another listed license. Users must comply with the applicable license, including attribution, non-commercial restrictions, share-alike requirements, no-derivatives rules, or other limitations. If a license conflicts with these terms, the stricter rule applies unless Orca states otherwise in writing.

Intellectual property complaints

If any user or rights holder believes content on Orca infringes copyright, trademark, design rights, patent rights, trade secrets, or other rights, the concern should be reported to [email protected] with enough information to identify the content and rights involved. Orca may remove or restrict content while reviewing rights issues.

Privacy

Orca processes personal information according to the Privacy Policy. Use of Orca may involve account records, beta application records, analytics records, Community activity, model claims, comments, and support messages.

No warranty

To the fullest extent permitted by applicable law, Orca is provided on an as-is and as-available basis. Orca does not warrant uninterrupted availability, error-free operation, secure access, accurate output, design safety, manufacturing quality, non-infringement, merchantability, or fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by applicable law, Orca, the Orca team, and Curvature Flow (Shenzhen) Technology Co., Ltd. are not liable for personal injury, property damage, product defects, failed manufacturing, assembly accidents, recall costs, data loss, business loss, indirect loss, consequential loss, lost profits, or other damages arising from use of Orca, Community models, or downloaded packages.

Indemnity

Users agree to be responsible for claims, losses, liabilities, damages, costs, and expenses arising from the user's unlawful use, unsafe fabrication, user content, rights infringement, breach of these terms, or violation of applicable laws, to the extent permitted by law.

Changes, suspension, and termination

Orca may modify features, update these terms, suspend services, remove content, or terminate access where necessary for security, legal compliance, abuse prevention, product development, or operational reasons. Continued use after changes means the user accepts the updated terms.
